These Terms of Service (“Terms”) govern your use of the FieldJoy mobile application (“App,” “FieldJoy,” “Service”) developed and operated by Creative Stack, LLC (DBA Simple Path Studio) (“we,” “us,” “our,” “Company”).

By downloading, installing, or using FieldJoy, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Acceptance of Terms

2.1 Agreement to Terms

By accessing or using FieldJoy, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2.2 Age Requirement

You must be at least 13 years old to use FieldJoy. If you are under 18, you represent that you have obtained permission from your parent or legal guardian to use the App.

2.3 Changes to Terms

We may modify these Terms from time to time. Material changes will be indicated by:

  • Updating the “Last Updated” date at the top of this document
  • Posting updated Terms at https://simplepath.studio/terms/fieldjoy/
  • Providing an in-app notice (for material changes, when feasible)

Your continued use of FieldJoy after changes become effective constitutes acceptance of the updated Terms.

3. License and Permitted Use

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use FieldJoy on devices you own or control for personal, non-commercial use.

3.2 License Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App (except where prohibited by law)
  • Remove, alter, or obscure proprietary notices
  • Rent, lease, lend, sell, redistribute, or sublicense the App
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or related systems
  • Transmit malware or harmful code
  • Use automated scripts, bots, or scrapers to access the App
  • Use the App in a way that could damage, disable, or impair the App

3.3 Commercial Use

Commercial use is prohibited without our express written permission.

3.4 Apple Terms

If you download FieldJoy from the Apple App Store, you also agree to Apple’s Licensed Application End User License Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

4. Your Data

4.1 Definition

“User Data” means information and content you create or store using FieldJoy, such as people and location information, visit records, conversation notes, plans, and tags.

4.2 Ownership

You retain all ownership rights to your User Data. We do not claim ownership of your User Data.

4.3 Storage

Your User Data is stored:

  • Locally: on your device
  • iCloud (optional): in your personal iCloud account if you enable sync
  • CloudKit sharing (optional): for collaborative group plans you create or join

4.4 Our Access to Your Data

We do not access, view, or process your User Data. We operate no servers that store or process your User Data.

4.5 Responsibility for User Data

You are responsible for:

  • The accuracy and legality of your User Data
  • Backing up your User Data (we recommend enabling iCloud sync and/or using export features)
  • Ensuring your User Data does not violate applicable laws or third-party rights

5. iCloud and CloudKit

5.1 iCloud Sync

If you enable iCloud sync:

  • Your User Data is stored in your personal iCloud account
  • Apple’s iCloud Terms of Service apply: https://www.apple.com/legal/internet-services/icloud/
  • Syncing requires an active internet connection and sufficient iCloud storage

5.2 Collaborative Group Plans

If you create or join a collaborative group plan:

  • Plan data is stored in a CloudKit shared zone
  • Participants you invite can view and edit shared plan data
  • Personal data such as conversation notes and visit history is not shared through group plans

5.3 Third-Party Services

We are not responsible for Apple service availability or reliability, iCloud storage limits or billing, or Apple’s privacy practices. Please contact Apple for Apple service issues.

6. Intellectual Property

FieldJoy and all related materials (software, design, graphics, text, user interface, and documentation) are owned by Creative Stack, LLC and protected by applicable intellectual property laws.

6.1 Trademarks

“FieldJoy,” “Simple Path Studio,” and associated logos may be trademarks of Creative Stack, LLC. You may not use our trademarks without our express written permission.

6.2 Feedback

If you provide feedback, suggestions, or ideas (“Feedback”), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use and incorporate the Feedback into FieldJoy without obligation to you.

8. Disclaimers

FIELDJOY IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8.1 Data Loss

We cannot guarantee prevention of all data loss or corruption, uninterrupted or error-free operation, or availability or reliability of iCloud sync. You are responsible for backing up your data.

8.2 Third-Party Services

We are not responsible for Apple services (including iCloud), iOS operating system issues, third-party services you choose to use with FieldJoy, or connectivity/usage charges.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATIVE STACK, LLC (DBA SIMPLE PATH STUDIO) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF FIELDJOY.

In jurisdictions where limitations are not permitted, liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Creative Stack, LLC (DBA Simple Path Studio) from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of FieldJoy, your User Data, or your violation of these Terms or applicable law.

11. Termination

You may stop using FieldJoy at any time by deleting the App. We may suspend or terminate access if you violate these Terms or if we discontinue FieldJoy.

Upon termination, your license to use FieldJoy ends. Your User Data remains on your device and iCloud (we cannot delete it).

12. Discontinuation

We may discontinue FieldJoy at any time. We recommend periodically exporting your User Data so you retain your information.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which Creative Stack, LLC is registered, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of state and federal courts located in that state for disputes arising from these Terms or your use of the App.

14. Apple-Specific Terms

If you download FieldJoy from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Creative Stack, LLC, not Apple.
  • Apple has no responsibility for FieldJoy or its content and has no obligation to provide support.
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.
  • Creative Stack, LLC is responsible for addressing product claims and intellectual property claims.
  • You will comply with applicable export laws.

15. General Provisions

  • Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement.
  • Severability: If any provision is unenforceable, the remainder remains effective.
  • No Waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without consent; we may assign without restriction.
  • Force Majeure: We are not liable for delays due to events beyond reasonable control.
